User Agreement

Please read this agreement carefully. By downloading, accessing, or using the Sunu Pay app or website, you confirm that you have read, understood, and agreed to be bound by these terms. If you do not agree, please do not use our services.

01 About Sunu Pay

Sunu Pay is a mobile payments platform that allows users to send and receive money, pay bills, and buy airtime across borders. Sunu Pay is operated by Sunu Pay Ltd ("we," "us," or "our").

By using Sunu Pay you enter into a legally binding agreement with Sunu Pay Ltd. These terms apply to all users of our app, website, and any related services.

02 Eligibility

To use Sunu Pay you must:

  • Be at least 18 years of age
  • Be a human individual (not a bot or automated system) unless you hold a valid business account with us
  • Provide accurate, truthful, and complete information when registering
  • Not be prohibited from using financial services under the laws of your country
  • Not have had a previous Sunu Pay account terminated for a breach of these terms

We reserve the right to refuse or close any account that does not meet these requirements.

03 Account Registration and Security

Creating your account

You must register using accurate personal information including your full legal name, phone number, and where required, government-issued identification. You agree to keep this information up to date.

Your responsibility for account security

You are solely responsible for maintaining the confidentiality of your login credentials, PIN, and any authentication details. You must not share your credentials with anyone.

If you believe your account has been compromised, you must contact us immediately at info@sunupay.app. We are not liable for any losses resulting from unauthorised access caused by your failure to protect your credentials.

One account per person

Each individual may hold only one personal account. Business accounts are separate and subject to additional terms. Creating multiple accounts to circumvent limits or restrictions is a violation of this agreement.

We use identity verification (KYC) procedures to comply with anti-money laundering regulations. You may be required to submit identity documents before your account is fully activated or transaction limits are raised.

04 Our Services

Sunu Pay currently offers or intends to offer the following services:

  • Sending money domestically and internationally
  • Receiving money via phone number or payment link
  • Paying utility bills and subscriptions
  • Purchasing mobile airtime and data
  • Business payment tools including invoicing, payment links, and sales tracking

We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice, and we will not be liable to you for doing so.

Sunu Pay is a pre-launch product. Some features may not yet be available or may be available only to selected users. We make no guarantee about the availability or functionality of any specific feature.

05 Fees and Exchange Rates

Transaction fees

Our current fees are displayed clearly within the app and on our website before you confirm any transaction. By confirming a transaction you agree to the fee displayed at that time.

Exchange rates

Where a currency conversion is required, we apply a real-time exchange rate at the time of the transaction. This rate may differ slightly from rates published by third parties. The exact rate applied will be shown to you before you confirm the transaction.

Changes to fees

We may change our fee structure at any time. We will give you reasonable notice of any material changes. Continued use of Sunu Pay after a fee change takes effect constitutes your acceptance of the new fees.

We do not charge hidden fees. The amount shown before you confirm is the amount that will be deducted. If you are ever charged differently, please contact us immediately.

06 Your Responsibilities

When using Sunu Pay you agree to:

  • Use the service only for lawful purposes
  • Provide accurate and up-to-date personal information at all times
  • Ensure you have sufficient funds before initiating a transaction
  • Verify recipient details carefully before confirming any payment (we cannot reverse transactions once processed)
  • Keep your device and login credentials secure
  • Notify us immediately of any unauthorised use of your account
  • Comply with all applicable laws and regulations in your country of residence

You are fully responsible for all activities that occur under your account, whether or not you authorised them, unless the unauthorised activity resulted solely from our negligence.

07 Prohibited Activities

You must not use Sunu Pay to:

  • Engage in money laundering, terrorist financing, or any other financial crime
  • Send or receive funds for illegal goods or services
  • Conduct fraud, deception, or impersonation of any kind
  • Circumvent or attempt to circumvent our security systems or identity verification
  • Use automated tools, bots, or scripts to interact with the platform without our prior written consent
  • Exploit bugs or vulnerabilities in our systems
  • Process payments on behalf of another person or entity without their explicit consent
  • Violate any applicable local, national, or international law or regulation
Violation of these prohibitions may result in immediate account suspension, termination, reporting to relevant authorities, and legal action. We cooperate fully with law enforcement investigations.

08 Transactions

Confirmation and processing

A transaction is initiated when you confirm it within the app. Once confirmed, transactions are generally final and cannot be reversed. Please double-check all recipient details before confirming.

Transaction limits

We may apply transaction limits to your account based on your verification level, account history, or applicable regulations. These limits may change over time and will be communicated to you within the app.

Refused or delayed transactions

We reserve the right to refuse, delay, or reverse any transaction that we believe may violate these terms, applicable law, or our compliance obligations. We will notify you where possible but are not always able to provide reasons.

Failed transactions

If a transaction fails after funds have been deducted from your account, we will return the funds to your account within a reasonable timeframe. We are not liable for losses resulting from failed transactions caused by third-party infrastructure, network outages, or recipient errors.

09 Intellectual Property

All content, branding, logos, trademarks, software, code, and design elements within the Sunu Pay app and website are the exclusive property of Sunu Pay Ltd or our licensors.

You may not copy, reproduce, modify, distribute, or create derivative works from any part of our platform without our prior written permission.

By submitting any content, feedback, or suggestions to us, you grant us a non-exclusive, royalty-free, perpetual licence to use that content for any purpose related to improving our services.

10 Privacy and Data

We take your privacy seriously. Our Privacy Policy explains how we collect, use, store, and protect your personal data. By using Sunu Pay you agree to our Privacy Policy.

We process your data in accordance with applicable data protection laws including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

We will never sell your personal data to third parties. We may share your data with trusted service providers, financial institutions, and regulatory bodies where required to operate our services or comply with legal obligations.

You have the right to access, correct, or request deletion of your personal data. To exercise these rights, contact us at info@sunupay.app.

11 Limitation of Liability

To the fullest extent permitted by law, Sunu Pay Ltd shall not be liable for:

  • Any indirect, incidental, special, or consequential loss or damage
  • Loss of profits, revenue, data, or business opportunities
  • Losses arising from your failure to keep your account credentials secure
  • Losses resulting from transactions you initiated, including payments sent to the wrong recipient
  • Service interruptions caused by third-party providers, network failures, or force majeure events
  • Any action taken by us in good faith to comply with legal or regulatory requirements

Where we are found liable, our total liability to you in any 12-month period will not exceed the total fees you paid to us during that same period.

Nothing in this agreement limits our liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

12 Indemnification

You agree to indemnify, defend, and hold harmless Sunu Pay Ltd, its directors, employees, and partners from and against any claims, losses, damages, penalties, and costs (including reasonable legal fees) arising out of or related to:

  • Your breach of this agreement
  • Your violation of any applicable law or regulation
  • Your use or misuse of our services
  • Any third-party claim arising from your actions on the platform

13 Suspension and Termination

By us

We may suspend or terminate your account at any time, with or without notice, if we believe you have breached this agreement, violated any law, or if we are required to do so by a regulator or legal authority. We may also close accounts that have been inactive for an extended period.

By you

You may close your account at any time by contacting us at info@sunupay.app. Any pending transactions at the time of closure will be processed in the normal course before the account is closed.

Effect of termination

Upon termination, your right to use Sunu Pay ceases immediately. Provisions of this agreement that by their nature should survive termination will do so, including sections on liability, indemnification, intellectual property, and governing law.

14 Changes to This Agreement

We may update this agreement from time to time. When we do, we will update the "Last updated" date at the top of this page and, where the changes are material, we will notify you by email or in-app notification with at least 14 days notice before the changes take effect.

Your continued use of Sunu Pay after the effective date of any changes constitutes your acceptance of the updated agreement. If you do not agree with any changes, you must stop using the service and close your account before the changes take effect.

15 Governing Law and Disputes

This agreement is governed by and construed in accordance with the laws of England and Wales. Any dispute arising from this agreement will be subject to the exclusive jurisdiction of the courts of England and Wales, unless otherwise required by the mandatory laws of your country of residence.

Dispute resolution

Before taking any formal action, we encourage you to contact us directly at info@sunupay.app so we can try to resolve the issue informally. We aim to respond to all complaints within 5 business days.

If we are unable to resolve a dispute informally, either party may escalate the matter through the appropriate legal channels.
